Upcoming Residential Symposium

The Northern California Chapter of the Appraisal Institute is holding its Residential Symposium on August 3rd, in Dublin, CA (SF East Bay). This event is an evolution to the Residential Tapas event held in Monterey, CA.

This is an all day event approved for California CE. Topics include:

· How is Collateral Underwriter actually used by lenders to review appraisals? We’ve all been told why CU was introduced and what it is supposed to do for the GSEs. But there has not been much talk about how the lenders actually integrate it into their appraisal quality & review process. We have a panel of Bank and AMC representatives who will discuss how they get their CU reports or findings, what they do with them, what causes a red flag, and how appraisers can proactively address a potential CU concern. This isn’t “theory”; this is how the CU is affecting appraisal QC/Review at the lender-level.

· A panel of AMC representatives will discuss the regulatory and client-driven issues that are affecting appraisers/AMCs/lenders. Panel selection & retention; what exactly does an AMC do (is it the same for all clients?); reconsideration process; new regulations that affect the work flow (and more).

· Appraiser Liability/Litigation & Legal Work for Appraisers. We have two local attorneys who will be speaking; one works for E&O companies defending appraisers and another who is an appraiser and specializes in litigation work as well as defending appraisers against BREA complaints. We will also talk about the opportunities available for residential appraisers in litigation field (how to break-in and how it differs from lending work).

· What’s it Worth? A panel of local appraisers providing examples of how to value some of the more atypical features/amenities within our local markets.

The Symposium is designed to present meaningful discussion of timely residential issues that residential appraisers deal with in their daily practice. Each presentation will be followed by a Q&A session so attendees have the opportunity to fully participate in the information exchange.

Q: Why should I take this course?

A: Rooftop solar PV is exploding for both the commercial and residential sectors. Our clients expect us to have the competency to meet the market demand.

Q: So is this a course primarily for residential or commercial appraisers?

A: Both. The concepts, principles and techniques are the same, no matter what kind of property you are appraising.

3)

Q: What makes this course particularly important for residential appraisers?

A: The GSEs won’t allow you to gain competency AFTER you take the assignment. You have to be competent BEFORE you accept it. Why not expand your market?

Q: Isn’t it available online?

A: No. It is only available as a classroom course, and there’s only one other offering on the West Coast this year.

Q: Don’t I have to take the other two Green courses before this one?

A: No. This is a stand-alone course. You can take the Intro and Case Studies Courses at a later date.

Q: Will I really be able to value solar PV when I go back to the office the next day?

2014 Fall Conference Recap

This year’s Annual Fall Conference was held on September 17th at the San Francisco Marriott. We had a great turnout of over 300 attendees from Northern, Central, and Southern California. Our 2014 Chair Tim Runde, MAI, LEED AP and the rest of the Fall Conference Committee did a wonderful job of putting together a fantastic program with a broad array of topics and presenters. At this year’s conference we aligned the sessions into four educational tracks that reflect the concerns commercial and residential appraisers have in 2014: Business Development, Markets and Methods, Real Estate and the Environment, and Developing Special Expertise. Attendees were able to stay in one track or pick and choose.

Our Keynote Speaker this year was Maria Ayerdi-Kaplan, the Executive Director of the Transbay Joint Powers Authority (TJPA). Ms. Ayerdi-Kaplan gave a very interesting and informative presentation on the Transbay Transit Center Program in San Francisco (Transbay Transformation: Enhancing Real Estate Values Through Transit-Oriented Development) with an appraisal focus with regards to rent premiums in the area, as well as leasing/sale and construction activity.

We were also very fortunate to have special guest J. Scott Robinson, MAI, SRA, AI-GRS, AI-RRS, the 2014 Appraisal Institute National Vice President join us for the day.

Additionally, two of our members were presented with awards at this year’s conference. Dawn Molitor-Gennrich, SRA was awarded the Claudia Carleton Leadership Award. Dawn’s dedication, every year, to the development and instruction of timely appraisal topics and issues truly benefits the greater appraisal community. Congratulations, Dawn! Nicholas Cadigan was presented with the Arlen C. Mills Education Award. Congratulations, Nick! This annual award was established in 2009 to honor Arlen Mills, MAI, SRA, for his many decades of educational service and diverse contributions to the educational betterment of all appraisers.

Following the afternoon sessions, attendees were encouraged to stay and network with their peers at the after-conference social.

Fall Conference Interview with Chair Tim Runde, MAI, LEED AP

This conference is in its 64th year. Tell us what’s new this year – what should we expect?

The biggest change for 2014 is that we’ve aligned the sessions into four educational tracks that reflect the concerns commercial and residential appraisers have in 2014: Business Development, Markets and Methods, Real Estate and the Environment, and Developing Special Expertise.  You can stay in one track or pick and choose – it’s up to you.

The Committee has pulled together a really diverse group of speakers including a number of panelists from outside the Bay Area – something you don’t often see in local real estate conferences.

So give us some examples of the speakers and topics we’ll be able to choose from.

  • Steve Herzog, MAI, CF, who literally wrote the book on water issues, is coming in from Portland.
  • Orell Anderson, MAI, from Los Angeles will speak on contamination and damages.
  • Jim Martin, Bureau Chief of the BREA in Sacramento will talk about what to expect on the regulatory front.
  • Roy Meyer is joining us from Orange County to demonstrate how to kick start your appraisal business and grow your “non-lender” residential and commercial business.

  • Ezra Rapport, executive director of ABAG, will speak on how recent California climate legislation will affect what gets developed where.
  • And we have an entire session focusing on residential and commercial green issues, which is shaping up to be a major competency issue with the pending release of The Appraisal Foundation’s Green Building Competency Guidelines.

We’re really excited to have Maria Ayerdi-Kaplan, executive director of the Transbay Joint Powers Authority and SF Business Times “Dealmaker of the Year” present this year’s keynote.   She’s the driving force behind the new Transbay Terminal that is leading the renaissance in San Francisco’s South Financial District.  The land deal Maria negotiated with Boston Properties for Salesforce Tower is the highest price land sale in SF history.  She’s a down-to-earth speaker with a great story to tell.

2014 Appraisal Institute Leadership Development & Advisory Council (LDAC) Recap

Each year approximately 100 appraisers from across the U.S. are selected to participate in the Appraisal Institute’s Leadership Development and Advisory Council (LDAC) in Washington, D.C. This year’s LDAC was held from May 19th through the 21st. LDAC brings together individuals involved in the real estate profession to foster creative thought while developing the future leaders of the Appraisal Institute. Further, LDAC establishes an “appraiser-presence” in Congress. For this year’s LDAC, the Northern California Chapter of the Appraisal Institute nominated and sponsored Melissa Downing, MAI and Michelle Sturtevant, MAI, R/W-AC to attend.

This year’s LDAC included four discussion topics: (1) Defining and Promoting the AI Designated Member Difference; (2) Embracing and Using Technology – Becoming a Technology Savvy Real Estate Appraiser; (3) Defusing the Succession Time Bomb – Solving the Trainee/Supervisor Dilemma; (4) Create New and Expand Existing Client Relationships (through unique, value added enhancements and market diversification that cause AI Designated members to stand out from other appraisers). Discussion Reports will be published from National in the near future, which will provide more details on each of the discussion topics.

In addition to participating in the discussion sessions, attendees had the opportunity to lobby on Capitol Hill. This year’s lobbying efforts focused on SBA 7(a) Loans for Special Purpose Properties and Protecting the Integrity of the Appraisal.

With regard to SBA Loans for Special Purpose Properties, late in 2013, the Small Business Administration (SBA) amended SOP 50-10F essentially preventing qualified real estate appraisers from performing “going concern appraisals” relating to loans for special purpose properties (involving properties under a change of ownership). As of January 1, 2014, SBA lenders are forced to obtain two appraisals – a real estate appraisal and a separate business valuation. Our lobbying efforts focused on urging members of the House and Senate to support legislation currently under development (Leuktemeyer/Schrader bill) that would reaffirm the acceptance of competent real estate appraisers to prepare going concern appraisals of special purpose properties for SBA 7(a) loans. The Senate was urged to introduce companion legislation for the Leuktemeyer/Schrader bill.

An additional focus of our lobbying efforts was on S.1217, the Housing Finance Reform and Taxpayer Protection Act, knows as “Johnson-Crapo,” in the Senate and H.R.2767, the Protecting American Taxpayers and Homeowners Act or “PATH Act” in the House. House Members were urged to protect the integrity of the appraisal by not allowing appraisal information in the “National Mortgage Data Repository” to be made publicly available. Similarly, attendees urged the Senate to protect the integrity of the appraisal, by not allowing any appraisal information found in the “National Mortgage Database” to be made publicly available.

The conference venue was the Renaissance Washington – DC Dupont Circle Hotel.  A beautiful and comfortable setting for the event.  The lobby area provided a welcoming place for meeting other attendees and networking all hours of the day and night.

After conference hours, Melissa and Michelle enjoyed sight-seeing in downtown Washington DC and took advantage of the Capital bike sharing program to sample wonderful restaurants and visit our nation’s national monuments.

Also, we’re pleased to announce that Melissa Downing, MAI received the Ted Anglyn Outstanding Participant Award for outstanding contribution as a first-year participant in the Leadership Development & Advisory Council!

This year’s LDAC was filled with thoughtful and creative discussions, proactive lobbying efforts, and the opportunity to socialize and network with some of the best and the brightest individuals involved in the real estate profession! 2014 Annual Spring Litigation Conference

Please join us for our 2014 Annual Spring Litigation Conference, presented by the Northern California Chapter of the Appraisal Institute. The May 15, 2014 conference will once again be held at Filoli, a historic site of the National Trust for Historic Preservation and one of the finest remaining country estates of the early 20th century, located in Woodside, CA. 2014 marks the 7th consecutive presentation of this annual award winning conference.

We will start the morning with: Decisions, Decisions: City of Perris v. Stamper. The dividing line between the Judge and Jury roles in Eminent Domain cases is constantly shifting. Eminent Domain is a unique area of law in which the Judge decides many issues of fact. Find out why the decision in this published case gives the Jury (not the Judge) the responsibility of determining issues of contested facts, and how an appraiser’s analysis can be the deciding factor in the “Judge vs. Jury” issue.

Then we move on to: Risky Business – What Appraisers Don’t Know About IRS work CAN Hurt. We will explore IRS Donation Appraisal Requirements, and the personal liabilities incurred by appraisers performing these appraisals.

Then after strolling through the Fioli gardens (optional self-guided tour) our lunch will be served on the Tennis Court Terrace, overlooking the gardens.

The afternoon starts with our Keynote Speaker: Judge W. Scott Snowden sharing his presentation on: Effective Expert Witness Testimony.

The afternoon continues with: CCC: The Collision of Condemnation & Contamination. We will explore the intriguing interaction of Condemnation Law and Practice with Contamination Law and Practice. As one might expect, property owners and condemning agencies have differing opinions in this area where the law is ambiguous at best, and some say even contradictory. Hear from leading experts on both sides of this controversial topic.

The education portion wraps up with: Legal Bits – A quick trip through what is new in California Real Estate Law, which is of interest to both appraisers and attorneys.

Then join us for social networking following this day of education, intrigue and controversy; there will be much to discuss.

2014 Annual Spring Conference Career & Exhibitor Fair Coming Soon!

Plan now to attend the 2014 Annual Spring Conference Career & Exhibitor Fair presented by the Northern California Chapter of the Appraisal Institute. The 2014 conference will be held on March 10th at the DoubleTree Hotel in Modesto.

The program will kick off the day with our annual State of the Profession session. This session highlights the issues that affect practicing appraisers on both a national and state level. The day will continue with multiple breakout sessions that include information on residential, commercial, and agricultural trends and issues facing the industry.

According to Conference Chair, Tiffany Mach, MAI, “This conference has become a great resource to provide attendees with cutting edge topics where they can gain a wealth of information within a single day, as well as interact with their peers.
